The agreement between you and us about the app and this website.

1. Who we are and what these terms cover

Word Search: Learning English ("the app") is published by Nicolas Gula, an independent developer based in Uruguay, under the dezeo name ("we", "us"). These Terms of Use are an agreement between you and us about the app for iOS and Android and this website at dezeo.lat/wordsearch. By downloading, installing or using the app you accept these terms. If you do not agree with them, please do not use the app.

Apple's and Google's own terms also apply to anything they provide: the download, the stores, payments and refunds. Where their terms give you more rights than ours, theirs prevail for those matters.

2. Who can play

The app is intended for players aged 13 and over (16 in the European Economic Area and the United Kingdom). If you are a minor, you may only play with the permission of a parent or guardian, who accepts these terms on your behalf and is responsible for any purchases made on their account.

3. Your license to play

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your own learning and entertainment. Everything in the app, including its code, artwork, stickers, illustrations, icons, sounds, recordings, word lists, translations, texts, the name "Word Search: Learning English" and its logo, belongs to us or to our licensors and is protected by copyright and trademark law. The license does not give you any ownership of the app or its content.

You may not, except where the law expressly allows it:

• copy, modify, translate, decompile, reverse-engineer or create derivative works of the app or its content;
• sell, rent, lend, redistribute or sublicense the app, or publish it under another name;
• extract or reuse the app's word lists, recordings, translations or artwork for your own products;
• use cheats, bots, exploits, modified builds or any tool that alters the app, its prices or its rewards;
• use the app's artwork, name or logo for your own products or promotions without our written permission;
• use the app in any way that is unlawful or that interferes with its operation or with the services it relies on.

Screenshots and short videos of your own gameplay, shared for non-commercial purposes such as social media, classrooms or reviews, are welcome.

4. Coins, hints and other virtual items

The app includes virtual coins, hints, medals, diplomas, badges and similar items ("virtual items"). Virtual items are a limited license to use a feature of the app; they are not money, have no value outside the app and cannot be exchanged for cash, goods or services. They cannot be transferred, sold or shared between players, and they do not accrue interest or any right against us.

Virtual items are stored only on your device. If you delete the app, change device or lose your device, your progress and virtual items are lost and we cannot restore them. The Remove Ads purchase can be restored from the store with the "Restore Purchases" button, because the store keeps a record of it.

We may adjust the app's economy over time, for example the price in coins of a hint or the coins a level rewards, to keep the game balanced. We will not take away virtual items you have already received without a good reason, such as cheating.

5. Purchases and refunds

All purchases are processed by Apple (App Store) or Google (Google Play), under their terms and with the payment method of your store account. Prices are shown in the store in your local currency, taxes included where applicable, and may differ between countries. We never see your payment details.

Because Apple and Google process the payment, refund requests must be made to them, through the App Store or Google Play, and are decided under their policies. We cannot issue refunds ourselves, and a refund of the Remove Ads purchase turns the ads back on.

6. Advertising

The app is free because it shows ads provided by Google AdMob: a banner during play, full-screen ads between some levels, and optional rewarded ads that you choose to watch for a hint. You can remove the banner and the ads between levels with the Remove Ads purchase. Ads are provided by third parties; we do not control their content and are not responsible for the products, services or websites they advertise. How ad data is handled is explained in our Privacy Policy, together with your choices about personalized ads.

Rewarded ads grant their reward only when the ad network reports that the ad was watched to the end. If an ad fails to load, for example without an internet connection, the reward is not available at that moment; this is not a fault in the app.

7. Learning content

The app teaches English vocabulary through pictures, recordings and translations prepared with care, but it is a game, not a certified course. The A1 to C1 labels follow the Common European Framework of Reference for Languages as a guide to difficulty; they are not an assessment of your level and do not confer any qualification. If you find a mistake in a word, a translation or a recording, please tell us at contact@dezeo.lat and we will fix it in an update.

8. Availability and changes

We work on the app continuously and may add, change or remove features, levels, words, items and prices in coins at any time, through updates or otherwise. We may also suspend or stop offering the app, or any part of it, with reasonable notice where possible, for example through the stores or this website. If we discontinue the app, we will try to give notice in advance; virtual items are a license to use features of the app and expire with it.

The app needs an internet connection for ads and purchases; everything else works offline. Some features depend on services run by Apple and Google, which may be unavailable from time to time for reasons outside our control.

9. Ending the agreement

You may stop using the app at any time by deleting it, which also deletes everything it stored on your device. We may end your license if you breach these terms, in particular by cheating or by using the app in an unlawful way. Sections 3, 4, 10, 11 and 13 continue to apply after the agreement ends.

10. Disclaimer

The app is provided "as is" and "as available", for learning and entertainment. To the extent permitted by law, we make no warranties, express or implied, about the app, including that it will be uninterrupted, error-free, compatible with your device or that any error will be corrected, or about any learning outcome. Nothing in these terms excludes rights that the consumer law of your country gives you and that cannot be excluded by agreement.

11. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of progress, virtual items or data, arising from your use of the app or the inability to use it. Where our liability cannot be excluded, it is limited, in total, to the greater of the amount you paid for purchases in the app in the twelve months before the claim, or the equivalent of USD 50. This limitation does not apply to liability for our willful misconduct or gross negligence, or to any liability that the law does not allow us to limit.

12. Feedback

If you send us suggestions or ideas about the app, you agree that we may use them freely, without any obligation to you, and you confirm that you have the right to share them. We will not use your name in connection with them without your permission.

13. Governing law and disputes

These terms are governed by the laws of Uruguay. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a dispute before the courts of that country. We will always try to resolve any issue directly first: write to us at contact@dezeo.lat.

For players in the European Union, the European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged, and do not undertake, to take part in dispute resolution before a consumer arbitration body.

14. Changes to these terms

We may update these terms when the app or the law changes. The "last updated" date at the top changes with every revision, and material changes will also be mentioned in the app's release notes. Continuing to play after a change means you accept the updated terms; if you do not, you can stop playing and delete the app.
